Terms of Service

Welcome to LingueLibrary. These Terms of Service ("Terms") govern your access to and use of the LingueLibrary website at linguelibrary.com and the LingueLibrary mobile application (collectively, the "Service"), operated by LingueLibrary ("we", "us", or "our"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By creating an account, accessing, or using LingueLibrary, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this age requirement. If you are under the age of 18, you represent that you have obtained the consent of a parent or legal guardian to use the Service.

3. Description of Service

LingueLibrary is a free language learning platform that helps users learn languages through reading adapted literary works. The Service includes:

• Access to a library of adapted books available at various CEFR proficiency levels (A2 through C2)
• Interactive word lookup with translations, verb conjugation tables, noun and adjective declension tables, and grammar information
• Vocabulary tracking, including word click analytics and saved word lists
• Personalized reading experiences based on your selected language and proficiency level
• Grammar-aware highlighting to visually distinguish parts of speech while reading

The Service is currently available for Italian and Norwegian, with additional languages planned. The Service is provided free of charge, with no in-app purchases, subscriptions, or premium tiers.

4. User Accounts

4.1 Account Creation

To access certain features of the Service, you must create an account using an email address and password, or by signing in with Google. You may also begin using the Service as an anonymous guest; guest accounts can be upgraded to full accounts at any time.

4.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information when creating your account
• Keep your login credentials secure and not share them with others
• Notify us immediately if you suspect unauthorized access to your account
• Accept responsibility for all activities conducted through your account

4.3 Account Deletion

You may delete your account at any time by contacting us. Upon account deletion, we will delete your personal data in accordance with our Privacy Policy. Some aggregated or anonymized data that cannot be used to identify you may be retained.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems, servers, databases, or other users' accounts
• Copy, reproduce, distribute, publicly display, or create derivative works from any content on the Service, including book texts, translations, word data, or grammar information, without our prior written consent
• Use automated tools, bots, scrapers, crawlers, or similar means to access, extract, or index data from the Service
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service or its underlying algorithms
• Interfere with, disrupt, or place an unreasonable burden on the Service or its infrastructure
• Transmit viruses, malware, or other harmful code through the Service
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the Service in a way that infringes upon the intellectual property or other rights of any third party

We reserve the right to suspend or terminate your access to the Service if we reasonably believe you have violated these acceptable use provisions.

6. Intellectual Property

6.1 Our Content

All content on LingueLibrary, including but not limited to adapted book texts, translations, word data, grammar tables, user interface designs, graphics, logos, and software, is owned by LingueLibrary or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its content solely for your personal, non-commercial language learning purposes.

6.2 Literary Content

The adapted book texts available on the Service are either original works, based on works in the public domain, or used under license. Our adaptations (simplified, level-adjusted versions) are original derivative works owned by LingueLibrary. The availability of adapted texts does not grant you any rights to the underlying original works.

6.3 Trademarks

"LingueLibrary" and associated logos are trademarks of LingueLibrary. You may not use our trademarks without our prior written permission.

7. User Content and Data

Content you create through the Service (such as saved word lists, reading progress, and vocabulary data) is associated with your account. We do not claim ownership of your personal learning data. However, you grant us a non-exclusive, royalty-free license to use, store, and process your user content as necessary to operate and improve the Service.

We may use aggregated, anonymized usage data (which cannot identify you personally) to analyze trends, improve our features, and enhance the overall quality of the Service.

8. Third-Party Services

The Service integrates with third-party services to provide certain functionality. These include:

• Firebase (Google LLC) for authentication
• DeepL SE for sentence translations
• Sentry for error tracking

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party providers.

9. Service Availability and Modifications

We strive to keep LingueLibrary available at all times, but we do not guarantee uninterrupted, secure, or error-free access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time, with or without notice. We may add, change, or remove features, content (including books), or functionality. We will make reasonable efforts to provide advance notice of significant changes that materially affect your use of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Translations, word data, conjugation tables, or other linguistic content will be completely accurate or free from errors
• The Service will meet your specific learning goals or requirements
• Any errors in the Service will be corrected within a particular timeframe

Our linguistic content is intended as a learning aid and reference tool. It should not be relied upon as a sole or authoritative source for professional translation, academic examination, or any purpose where inaccurate language information could cause harm.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LINGUELIBRARY, ITS OPERATORS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (EUR 100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless LingueLibrary and its operators, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we reasonably believe that you have violated these Terms or that your use of the Service poses a risk to the Service, other users, or third parties.

You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ceases immediately. The following sections survive termination: Sections 6 (Intellectual Property), 7 (User Content and Data), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), 15 (Governing Law and Dispute Resolution), and 16 (General Provisions).

14. Apple App Store Terms

If you access the Service through the LingueLibrary iOS application downloaded from the Apple App Store, the following additional terms apply:

• These Terms are between you and LingueLibrary only, and not with Apple, Inc. ("Apple"). Apple is not responsible for the Service or its content.
• The license granted to you for the app is limited to a non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to furnish any maintenance or support services for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including but not limited to product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claim related to the app.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law principles.

15.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Norway.

15.3 EU Consumer Rights

If you are a consumer in the European Union, you may also be entitled to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Nothing in these Terms affects your statutory rights as a consumer under applicable EU or national law.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and LingueLibrary regarding your use of the Service, and supersede all prior agreements and understandings, whether written or oral.

16.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by LingueLibrary to be effective.

16.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, pandemics, or labor disputes.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice through the Service or by email. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
